Service Agreement

1. Introduction

1.1 This Service Agreement ("Agreement") governs the purchase and delivery of personalized children's stories created using artificial intelligence through the Skazka.ai platform.

1.2 The Service is provided by LLC EVALLUME ("Provider," "we," "us"):

1.3 The Customer ("you") is any individual who is at least 18 years old and makes a purchase through our website at skazka.ai/us.

1.4 By completing a purchase, you accept this Agreement, our Terms of Service, and our Privacy Policy.

2. Services Offered

2.1 Skazka.ai provides personalized children's stories generated using artificial intelligence, featuring your child as the main character. The Service includes:

• AI-generated story text personalized with your child's name and details
• AI-generated illustrations featuring your child's likeness
• Delivery in the format you select (digital PDF or printed book)

2.2 Free Preview: Before purchase, we provide a free preview with a choice of 7 illustration styles. This allows you to see the quality before committing to a purchase.

2.3 Personalization is based on the following information you provide:

• Child's first name
• Child's age range
• Child's gender
• Child's photo (for creating an AI avatar; original photo is immediately deleted after avatar creation)
• Eye color and interests (optional)
• Custom dedication message (optional)

3. Pricing

3.1 Current pricing (all prices in USD):

3.2 Prices shown on the website do not include applicable sales tax. Any applicable taxes will be calculated and displayed at checkout before you complete your purchase.

3.3 We reserve the right to change prices at any time. Price changes do not affect orders already placed.

4. Payment Processing

4.1 Merchant of Record:

All payments are processed by Lemon Squeezy, which acts as our Merchant of Record. This means:

• Lemon Squeezy is the legal seller of record for your purchase
• Your payment is processed securely by Lemon Squeezy
• Lemon Squeezy handles sales tax and VAT compliance
• Your receipt and billing statement will show "Lemon Squeezy" or "LMSQUEEZY"
• Lemon Squeezy's payment terms apply to your transaction

4.2 By making a purchase, you also agree to Lemon Squeezy's Terms of Service.

4.3 Printed Book Payments: Printed book orders are processed directly through Stripe. For these purchases, LLC EVALLUME is the seller of record. By purchasing a printed book, you also agree to Stripe's Consumer Terms.

4.4 Payment Methods: We accept:

• Credit cards (Visa, Mastercard, American Express, Discover)
• Debit cards
• PayPal
• Apple Pay / Google Pay (where available)

4.5 Payment is considered complete when we receive confirmation from the respective payment processor that your payment has been successfully processed.

4.6 Upon successful payment, you will receive a confirmation email with your order details and a link to track your order status.

5. Delivery

5.1 Digital Stories:

• Generated within 30–40 minutes of payment
• Available for download in your account dashboard
• High-resolution PDF compatible with all devices
• Unlimited text editing and 3 free illustration regenerations

5.2 Printed Books:

• Production time: 5-7 business days
• Shipping time: 5-10 business days within the United States
• Tracking information provided via email once shipped
• Shipping to US addresses is included in the price
• International shipping available at additional cost (contact support)

5.3 Delivery times may be extended during peak periods or due to circumstances beyond our control (holidays, weather, carrier delays).

5.4 You are responsible for providing accurate shipping information. We are not responsible for delays or non-delivery due to incorrect addresses.

6. Refund Policy

6.1 Refund Eligibility:

• Before generation starts: Full refund, no questions asked
• Technical failure: Full refund or free re-generation if we fail to deliver
• Quality issues: If story contains significant errors or defects, full refund or re-generation
• Printed book damage: Full replacement or refund for books damaged in shipping

6.2 Non-Refundable Situations:

• After successful delivery of digital story (subjective reasons like "didn't like the story")
• Poor quality due to low-resolution photo provided by customer
• After printed book production has begun (for printed orders)
• Change of mind after successful delivery

6.3 How to Request a Refund:

Contact us at support.us@skazka.ai with:

• Your order number
• Reason for refund request
• Any relevant screenshots or details

6.4 Refund Processing:

• Refund requests reviewed within 2 business days
• Approved refunds processed within 5-10 business days
• Refunds returned to original payment method
• Refunds are processed through Lemon Squeezy

7. Your Rights and Obligations

7.1 You have the right to:

• Receive a free preview before purchasing
• Receive your purchased story in the format selected
• Contact customer support for assistance
• Request a refund in accordance with our refund policy
• Use created stories for personal, non-commercial purposes

7.2 You are obligated to:

• Provide accurate information during order placement
• Confirm you are the parent or legal guardian of the child featured
• Provide clear, high-quality photos for best results
• Maintain confidentiality of your account credentials
• Review the preview before making a purchase decision
• Not use the Service for commercial purposes without permission

8. Our Rights and Obligations

8.1 We are obligated to:

• Deliver services as described within stated timeframes
• Protect your personal information and your child's data
• Immediately delete the original photo after AI avatar creation — we do not store photos
• Store the AI avatar in the user's account for use in all future stories, until account deletion or user request
• Delete unpaid previews within 5 days (avatar and child's data remain in the account)
• Provide customer support for order-related issues
• Process refunds in accordance with our refund policy

8.2 We reserve the right to:

• Refuse service without explanation (with full refund)
• Modify service features and pricing
• Use anonymized examples for marketing (no identifying information)
• Suspend accounts that violate our Terms

9. Intellectual Property

9.1 All rights to created stories (text and illustrations) are owned by LLC EVALLUME.

9.2 Upon purchase, you receive a non-exclusive, personal license to use the created story for personal, non-commercial purposes including:

• Reading with family
• Printing copies for personal use
• Sharing online for non-commercial purposes
• Creating backups

9.3 Commercial use (selling, licensing, distributing for profit) requires our written permission.

10. Limitation of Liability

10.1 Our maximum liability for any claim related to this Agreement is limited to the amount you paid for the specific order giving rise to the claim.

10.2 We are not liable for:

• Delays caused by circumstances beyond our control
• Results affected by low-quality input (photos, information)
• Subjective dissatisfaction with AI-generated content
• Actions of third-party services (payment processors, shipping carriers)
• Indirect, incidental, or consequential damages

11. Governing Law

11.1 This Agreement is governed by the laws of the State of Wyoming, United States.

11.2 Any disputes shall be resolved in the courts of Sheridan County, Wyoming.

11.3 Before filing any legal claim, you agree to contact us to attempt informal resolution. We will respond to disputes within 30 days.

12. Changes to This Agreement

We may modify this Agreement at any time by posting the updated version on our website. Changes are effective immediately upon posting. Changes do not affect orders already placed and paid for.
