1. What this document is
1.1. This is the separate, explicit consent you give when you upload a photo or record your voice in SkazkaAI, together with our public policy on how long we keep biometric data and how we destroy it. We process biometric data only where this consent is given and only for the purposes below. It is meant to provide the written release, the public retention schedule, and the explicit consent that laws such as the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act, and GDPR Art. 9(2)(a) require.

1.3. The consent covers two independent cases, each given with its own checkbox and needed only for the matching feature: (A) a photo β to create a stylized avatar; (B) your own voice β for narration in your voice (Audio Clone). Without the relevant consent that feature is unavailable; the rest of the Service remains usable.
1.4. Consent is given by an adult (18+). For a child's photo it is given by the child's parent or legal guardian, who confirms their authority. If you upload a photo of another person, you confirm that you have obtained their consent to the same processing (for a child β the consent of their parent or guardian).
2. The text you see and accept
2.1. The text below is shown next to the checkbox that you must tick before the upload or recording continues. The Site keeps the version of this consent and the time you gave it in your account. If you use the Site in another language, you see a translation of the same text with the same meaning.
(A) When you upload a child's photo
βI am 18 or older and I am the child's parent or legal guardian. I consent to processing the child's photo as biometric data to create an avatar, including sending it to OpenAI (USA), our image-generation provider. If I upload photos of other people, I confirm I have obtained their consent to the same processing (for children β their parents' consent). The original photo is deleted when the avatar is chosen; if none is chosen, it is deleted automatically after 3 to 7 days.β
(A) Under a photo sent in the story chat
βBy sending a photo you confirm you have the consent of the person shown (for children β their parents'). The photo is sent to OpenAI (USA) to create the character image. The original is deleted when you confirm the image; if you don't, it is deleted automatically after 3 to 7 days. Full terms are in the consent you accepted when creating your hero.β
(B) When you record your voice β βBiometric Voice Consentβ
By tapping "Agree", you confirm the following:
- We process a sample of your voice (~30β60 seconds) as biometric data to create a synthesized copy of your voice (Audio Clone).
- The copy is used exclusively to narrate your personalized stories on your SkazkaAI account.
- A temporary voice model is created at ElevenLabs each time a narration or preview is produced, and deleted right after. Your voice recording is kept in your account (private cloud storage) so you can narrate future stories without recording again. You can delete it at any time in your account or by email; in any case we delete it no later than 3 years after you last used it for a narration.
- Processing occurs on the subprocessor ElevenLabs' infrastructure, which may be outside your country (international transfer). Record only your own voice β recording a child's voice or another person's voice is not allowed.
Checkbox: βI am 18+, this is my own voice, and I consent to processing it as biometric data for Audio Clone, including transfer to the subprocessor ElevenLabs.β
3. Consent A β photo

4. Consent B β your voice

Record only your own voice. Audio Clone is available only for the adult Customer's own voice; recording a child's voice or another person's voice is not allowed. Narration personalized for a child can also use a synthetic voice (Audio AI) that is not a copy of any real person's voice.
5. Retention schedule and destruction guidelines
We permanently destroy biometric data when the purpose for which we collected it has been satisfied or within 3 years of your last interaction with us, whichever occurs first. In practice:

To have any of the above deleted on request, including your whole account, write to privacy@skazka.ai; we respond within 30 days.
6. Your rights and withdrawal of consent
6.1. Consent is voluntary. You (or, for a child, the legal guardian) may withdraw it and ask us to delete the data at any time by writing to privacy@skazka.ai; a voice recording you can also delete yourself in your account.
6.2. Withdrawal stops further processing. The original photo has normally been deleted already (Β§5); a stored voice recording is deleted; on request the avatar and narrations in your account are deleted too. Withdrawal does not affect the lawfulness of processing before it and may make the matching feature unavailable.
6.3. Other rights (access, correction, restriction, portability, and so on) are described in the Privacy Policy.
7. Duration and changes
7.1. The consent lasts from the moment you tick the box until its purpose is achieved (photo β the avatar is chosen; voice β you delete the recording, and in any case 3 years after you last used it) or until you withdraw it, whichever is earlier.
7.2. If we change this consent, the new text and version are shown the next time you upload a photo or record your voice, and this page is updated. Earlier consents remain recorded with the version you accepted.
